Firstly I must state that I'm no legal expert but I'm going to attempt an explanation that I thing in principle may answer your question.

I believe that basically one must pay for a sexual act to be preformed for the purpose of his sexual gratification. Prostitution is deemed "a lewd act between persons for money or other consideration."

The catch is tho that porn-stars are paid to act (and yes apparently you can perform sex as part of ones role) and not for there own on set gratification, It's all about intent apparently. However fluffers are not payed for acting they're paid for sexual gratification.
