![]() Yep-barely in the business five minutes, but if you hang out with Bay & Daly & live their lifestyle that is the risk you run-not feeling sympathy for anybody who gets it from unprotected sex outside of porn, or shooting up with dirty needles.

CHATSWORTH, Calif.—FSC/PASS issued the following statement Wednesday afternoon about the contact geneology for the third adult performer reported last Friday to have tested positive for HIV: The third performer to test positive for HIV does not appear to have contracted the virus while performing in adult film. Three doctors from the PASS medical advisory board announced to FSC that all performers who worked with Performer 3 have tested negative. As with Cameron Bay and Rod Daily, all evidence points to private exposure to virus, which was identified before entering the performer pool by existing protocols. Despite the fact that none of the three recent cases resulted from on-set exposure, the doctors have elected to conduct additional investigative work prior to lifting the moratorium. While the third performer’s positive test is not linked to Mr. Daily or Ms. Bay in the workplace, we’re investigating to see if there was possible personal contact and if other people who perform in the industry were exposed privately. While we realize companies are struggling under the moratorium, our first priority must be establishing the safety of the workplace for our performers. This work will take at least until the end of the week and more likely into the first part of next week to complete. Once the physicians involved have established that no other performers were exposed, and that there is no risk of additional exposure, they will meet again and discuss the conditions and dates for lifting the moratorium. In the meantime, as an industry, we should give what support we can to Ms. Bay, Mr. Daily and the third affected performer. No matter how it was contracted, they are members of our community and deserve our compassion, and respect for coming forward and helping to identify anyone who might have been exposed. We will continue to provide updates as more information becomes available.

CANOGA PARK, Calif.—The FSC today released the following statement announcing that adult production can resume on Friday and that all performers must be tested on or after Thursday in order to be cleared in the PASS system. The organization also announced a new 14-day testing protocol industrywide. The Free Speech Coalition’s (FSC) PASS (Performer Availability Screening Services, formerly APHSS) Program announced today that the moratorium will be lifted Friday, Sept. 20. All performers must test on or after Thursday, Sept. 19, in order to be cleared to work. Additionally, all performers will now be required to test every 14 days in order to be cleared for work. “Our industry protocols are designed to be conservative and our doctors support a conservative approach, for the health and well-being of the performers,” said Diane Duke FSC Chief Executive Officer. “That is why moving forward, the physicians have recommended and we have implemented, a 14-day testing protocol.” The change in policy comes after three performers tested positive for HIV. Subsequent tests of scene partners established that the virus did not originate and was not transmitted on-set, and PASS doctors worked closely with the performers to identify 1st generation exposures. No additional incidences of HIV have surfaced. Sept. 19 marks 14 days since Patient 3 tested positive for HIV. The window period for the HIV RNA Aptima test is seven to ten days, but industry protocols dictate that retests occur 14 days or later as an added precaution. In addition to the change to a 14-day testing period, FSC’s PASS program plans to work with doctors, workplace safety specialists and performers to support a performer education program. “We can do more to help our performers learn how to protect themselves, on screen and off,” Duke stated. “While the increased testing will further ensure safer sets, it is important that we remain vigilant. Going forward, we need to constantly look to both performers, producers and health care professionals to find ways to improve our protocols.”
